1. Agreement to These Terms
These Terms of Use ("Terms") govern your access to and use of the MasonPilot website, calculators, quote-request forms, content, and related services.
By using the site, you agree to these Terms. If you do not agree, do not use the site.
2. What MasonPilot Provides
MasonPilot provides project-planning tools, estimate tools, quote-request forms, and related information for hardscape and masonry-related projects.
The site is intended to help users estimate, organize, and submit project information for review. It is not a guarantee of final scope, availability, delivery, or price.
3. Estimates Are Informational Only
Unless we clearly say otherwise in a separate written agreement, all results, calculations, estimated quantities, estimated pricing, planning suggestions, and material outputs shown on the site are for informational and planning purposes only.
Actual results may vary based on site conditions, grading, access, waste, cuts, compaction, drainage, availability, manufacturer changes, delivery conditions, labor assumptions, field measurements, and other factors.
Submitting a quote request does not create a binding contract and does not guarantee that we will accept, price, schedule, or fulfill the request.
4. No Professional Engineering or Construction Advice
The site does not provide engineering, architectural, surveying, legal, or other licensed professional advice.
You are responsible for confirming site conditions, dimensions, permitting requirements, code compliance, safety requirements, and final construction details before starting any project.
5. Your Responsibilities
You agree that:
- the information you submit will be accurate to the best of your knowledge
- you will not knowingly provide false, misleading, or fraudulent information
- you will submit only photos and content you have the right to share
- your use of the site will comply with applicable law
6. Prohibited Use
You may not:
- use the site in a way that interferes with normal operation or security
- attempt unauthorized access to the site, server, admin area, or data
- scrape, spider, harvest, copy, or systematically extract site content or calculator outputs using bots, scripts, or automated means without written permission
- reverse engineer, benchmark, clone, or use the site or its outputs to build a competing product or service
- submit malicious code, spam, abusive content, or unlawful material
- use the site for any fraudulent, deceptive, or unlawful purpose
7. Uploaded Content and Quote Submissions
When you submit information, photos, or other content through the site, you grant MasonPilot a limited, non-exclusive right to store, review, transmit, and use that content solely for purposes of evaluating your request, preparing or refining quotes, communicating with you, and operating the service.
You retain ownership of your uploaded content, but you are responsible for making sure you have the right to submit it.
8. Intellectual Property
The site, including its design, layout, branding, text, graphics, software, calculator logic, workflows, compilations, and related materials, is owned by MasonPilot or its licensors and is protected by applicable intellectual property laws.
Except for personal, non-commercial use of the public site for its intended purpose, no part of the site may be copied, reproduced, distributed, republished, or exploited without prior written permission.
9. Third-Party Content and Links
The site may reference or link to third-party brands, manufacturers, suppliers, websites, or content. Those references are for convenience or identification only and do not necessarily imply endorsement.
We are not responsible for third-party websites, services, availability, accuracy, or policies.
10. Disclaimer of Warranties
The site and all content, calculations, and services are provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, MasonPilot disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
We do not guarantee that the site will be uninterrupted, error-free, secure, or free from harmful components, or that estimate outputs will be complete, accurate, or suitable for your specific project.
11. Limitation of Liability
To the fullest extent permitted by law, MasonPilot and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of opportunity, business interruption, or project losses arising out of or related to your use of the site.
If MasonPilot is found liable for any claim arising out of your use of the site, our total liability will not exceed the greater of:
(a) the amount you paid us directly for the specific service giving rise to the claim, or
(b) $100.
12. Indemnification
You agree to defend, indemnify, and hold harmless MasonPilot and its owners, operators, affiliates, employees, contractors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses arising out of:
- your violation of these Terms
- your misuse of the site
- your submitted content
- your violation of any law or the rights of another person
13. Suspension or Termination
We may suspend, restrict, or terminate access to the site or any part of it at any time, with or without notice, if we believe it is necessary for security, maintenance, abuse prevention, legal compliance, or protection of our business or users.
14. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the site shall be brought in the state or federal courts located in Connecticut, and you consent to that jurisdiction and venue.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version and revise the "Last Updated" date. Continued use of the site after changes become effective means you accept the revised Terms.
